Joe Biden’s tyrannical jab mandate just took another devastating blow in court, and pro-freedom Americans are rejoicing.
“A U.S. appeals court on Friday affirmed its decision to put on hold an order by President Joe Biden for companies with 100 workers or more to require covid-19 vaccines, rejecting a challenge by his administration,” reported Reuters. (…)
According to the ruling, they said Biden’s mandate was “staggeringly overboard”:
“We next consider the necessity of the Mandate. The mandate is staggeringly overboard,” the appeals court says. (…)
The judges added that a 28-year-old trucker who spends his work day alone is less at risk from coronavirus than a 62-year-old prison janitor. The mandate fails to consider the nuances of different workplaces and workers’ different exposure risks, the court said.
“Likewise, a naturally immune unvaccinated worker is presumably at less risk than an unvaccinated worker who has never had the virus. The list goes on, but one constant remains – the Mandate fails almost completely to address, or even to respond to, much of this reality and common sense,” they conclude.
The court had on Nov. 6 issued a temporary halt to the mandate while litigation plays out over its legality.
Texas Attorney General Ken Paxton praised the Fifth Circuit Court’s ruling. (…)
“Citing Texas’s ‘compelling argument[s],’ the 5th Circuit has delayed OSHA’s unconstitutional and illegal private-business vaccine mandate,” he said on Twitter. “WE WON! Litigation will continue, but this is a massive victory for Texas and for FREEDOM from Biden’s tyranny and lawlessness.”
At least 27 U.S. states, as well as private employers, religious organizations, and other groups, have sued the Biden administration, saying it is exceeding its authority in issuing the mandate.
